By accessing the website of KITE TROTTER the user accepts the Terms of Use set out herein. Throughout these Terms of Use the term “KITE TROTTER” or "we" or "us" refers to Kite Trotter AG, Bahnhofstrasse 10, 6302 Zug, Switzerland. Any special agreements with respect to individual services or products provided by KITE TROTTER shall be complementary to these Terms of Use. In the event of any conflict the provisions contained in any such special agreement shall prevail.

We respect your private and personal. It is a major concern for KITE TROTTER that your personal data is treated in a responsible manner and in compliance with legal requirements. In close cooperation with our hosting provider, we make every effort to protect the databases as well as possible from outside access, data loss, misuse or falsification.

This online privacy statement (“statement”) describes the way we process your personal information when you visit our website or when you use services via our website. In relation to our processing of personal data within the scope of the General Data Protection Regulation (GDPR) of the European Union, this privacy statement is supplemented by the privacy statement (EU/EEA) and based on Article 13 of the Federal Constitution and the provisions of federal data protection legislation.

PROCESSING PERSONAL DATA

In addition to contact information such as your name, telephone number, address, e-mail address (or other information you give us as part of an order or participation in a contest or survey, for example), in some circumstances also your IP address, which we log when you visit our site, and other information like the pages you looked at and your reactions to offers displayed on our site are also part of the personal data that we collect.

With the KITE TROTTER Login you can use/manage products and services. After registering and signing in with your login information, we are able to link your online usage data (e.g. how you use our Internet sites and services) with other customer data that we capture and process in conjunction with your usage of our products and services. We can then use that information to offer services and functions, for marketing purposes and for the evaluation, improvement and new development of services and functions.

WEB ANALYSIS & TRACKING TECHNOLOGIES

We use Web analysis tools to get information about how people use our sites and Internet offerings. These tools are usually provided by third parties. Typically, the information for this purpose is captured with cookies and sent to a third-party server. Depending on the provider, these servers are sometimes in other countries.

The transfer of information is done by using shortened IP addresses, which prevents the identification of individual end-user devices. Your IP address is not linked with other data from these third parties. Any onward transfer by third parties will only be based on legal regulations or as part of a data processing service agreement.

We use retargeting technologies on our Internet websites. This lets us appeal to users of our Internet websites with advertising on third-party Internet websites. The advertisements displayed on Internet websites you visit is based cookies in your browser, a cookie ID and an analysis of previous usage.

SOCIAL MEDIA PLUG-INS

We use so-called social plug-ins on our websites. All of the plug-ins we use are set up with two-click functionality. They are only activated if you click on the icon. Plug-ins can be recognised by their social network logos.

When you open one of our websites that has an activated plug-in, your browser will create a direct connection to the provider’s servers. The content of the plug-in is sent directly from the provider to your browser and integrated into the site. By integrating the plug-in, certain information is sent to the third party and saved by them.

If you are not a member of the social network in question, your IP address may still be captured and saved by the network via the social plug-in. If you are already logged into the social network, the third parties can immediately link your visit to our websites to your personal profile in the social network. If you interact with the plug-ins, for example with the “Like”, “+1”, “Twitter” or “Instagram” buttons, the corresponding information will also be sent directly to a server at the third party and saved there. The information is also published on the social network, in your Twitter or Instagram account and then shown to your contacts. If you would like to prevent Google, Facebook, Twitter or Instagram from linking your personal information captured on our websites with the social networks in question, you need to log out of that social network before visiting our website. You have the right to obtain information in writing and free of charge about the personal data of yours that we process. Your request for information must be issued in writing, include a copy of your ID card or passport, and be sent to our postal address.

You likewise have the right to request the correction of incorrect personal data. You may also demand the deletion of your personal data unless the applicable laws and regulations oblige us to store your personal data.

Copyright and any other rights relating to texts, illustrations, photos or any other data available on the KITE TROTTER website are the exclusive property of KITE TROTTER or of any other expressly mentioned owners. Downloading or copying of texts, illustrations, photos or any other data does not entail any transfer of rights on the content. Any reproduction requires the prior written consent of the copyright holder.

By uploading an image or video you guarantee that you have read and that you agree to abide by all clauses within these Terms and Conditions. You also understand and agree that nothing in this agreement obligates KITE TROTTER to display or use your Images.

By uploading an Image to KITE TROTTER you guarantee that you are the legal owner of the copyright of that Image, or have been awarded full and unrestricted rights from the copyright owner to upload and utilise the Image for the purposes of KITE TROTTER or any other distribution channels including, but not limited to the KITE TROTTER website. Images that are considered to infringe the copyright or trademarks of other individuals, organisations or companies will be deleted.

By uploading an Image you guarantee that such use of the Image on KITE TROTTER does not violate the rights of any other party, does not result in a breach of contract between you and another party and that you accept responsibility for any royalties or fees due to any other party from the use of the uploaded Image.

By uploading an Image you guarantee that any people which are clearly identifiable have consented to have their likeness printed or displayed, or that you have full rights to use the Image in this manner and accept full responsibility for such use.

All Images uploaded to KITE TROTTER will be assessed by an KITE TROTTER Editor for suitability. This Editor will either reject or accept each Image for use in the Guides. Images that are rejected will be deleted from KITE TROTTER entirely, with no copies remaining in the KITE TROTTER system. The decisions of the Editor are irrevocable. KITE TROTTER reserves the right to reject and remove any uploaded Image from display on its website, for any reason, at any time, without prior notice.

When uploading an Image you are solely responsible for its content and for any offence, claims or damages that arise from the content of that Image. The approval and publication of Images in the Guides by an KITE TROTTER Editor in no way alters or diminishes your responsibility. Nor does it transfer any responsibility for the content of the Image to KITE TROTTER or the Editor who approves the Image for publication.

KITE TROTTER does not claim any copyright or any kind of ownership rights to the Images you upload to KITE TROTTER. However, by uploading an Image to KITE TROTTER you thereby grant to KITE TROTTER and its licensees a royalty-free, non-exclusive, worldwide right to copy, crop, reproduce, edit, publish, display, distribute or otherwise use the image or video publically in all languages and all media, whether now known or hereinafter devised, including without limitation including in the Guides in perpetuity.

KITE TROTTER guarantees that it will not create any derivative work from your Images nor modify the content without your consent, though it reserves the right to crop images or videos or to make adjustments to the brightness, exposure, colours or general appearance of any Image that it believes warrants such adjustment for the purpose of better display.

KITE TROTTER may select certain Images that you upload to KITE TROTTER for promotional activities including but not limited to own promotional materials either on-line or in printed form.

You should only upload Images that are relevant and appropriate to your campsite. You must not upload photographs that contain objectionable content, including but not limited to nudity, violence, and other offensive, illegal or inappropriate images or videos. The content of some Images - particularly nudity - might be offensive to persons from cultures whose values differ from yours. Thus KITE TROTTER reserves the right to delete Images its Editors consider potentially offensive to some as 'sensitive'. 

You agree to indemnify and hold KITE TROTTER and its subsidiaries, affiliates, officers, employees and representatives free from any claim or demand made by any third party due to or arising out of your uploading to KITE TROTTER of any Images or from any violation of any other party's rights caused by the use of or the content within the Images you upload.

 

REVIEW
 

By submitting any content, you are agreeing to our terms and conditions. For the purposes of this statement, “submitted content” refers to any data communicated from you to us or our partners for purposes of publication by telephone, fax, email, or in writing, AND to any data transmitted electronically by you to us and our partners.

Submitted content must not be:

•    a marketing nature or marketing purposes,
•    unlawful, deceptive, misleading, nonsensical, infringe copyright, rights of third parties, fraudulent, threatening, abusive, harassing, libellous, indecent, defamatory, tortious, obscene, pornographic or profane,
•    sexist, political or racial character or contain any other form of illegal or unpleasant material,
•    violating other people's rights, including any intellectual property rights,
•    offensive or in any way breaches any applicable local, national or international law or regulation,
•    violating these terms and conditions, 
•    disloyal or unlawful purpose and/or content (or promotes unlawful purposes),
•    technically harmful (including without limitation computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software, harmful data or conduct).

KITE TROTTER has a zero-tolerance policy on fake reviews. By sending us a review, you certify that this review is based on your own experience and is your genuine opinion, and that you have no personal or business relationship behind, and have not been offered any incentive or payment originating to write this review. 

We validate the transmitted content and reserve the right to edit your review as we see fit. Also, we may decide not to publish your review. This would be at our discretion, but might be because it's too long, has too many typos, seems suspiciously biased one way or another, or just that it's not the kind of thing we're looking for.

Occasionally people or organisations contact us asking to use our reviews. If someone else wants to use all or part of your review, we will try to let you know using the contact details you have provided. If we can't get in touch with you, then be warned – we may go ahead and allow them to use it anyway! We ask you to submit contact details with your review. This is to help us verify your review is genuine and because we might need to contact you. This could be because we want to invite you onto the official reviewers list, or because a venue would like more details about something you mention in your review. If you wish to offer your review for re-publication elsewhere you must obtain our prior permission, and the review must be accompanied with the words "This review has previously appeared at KITE TROTTER".

You grant us the right to use the "name/nickname" that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify KITE TROTTER for all claims resulting from content you supply. We have the right but not the obligation to monitor and edit or remove any activity or content. KITE TROTTER takes no responsibility and assumes no liability for any content posted by you or any third party.
